itemprop=\"text\" ><p>Estan obligats els baixos comercials a fer front a les despeses de l&#8217;ascensor de la comunitat si no l&#8217;utilitzen? Existeix una normativa que establisca si aquests locals han de contribuir com la resta dels ve\u00efns a la instal\u00b7laci\u00f3 o reforma de l&#8217;ascensor? Qu\u00e8 succeeix quan una comunitat instal\u00b7la un ascensor despr\u00e9s de l&#8217;elaboraci\u00f3 dels seus estatuts i no queda clar si els baixos comercials han de pagar-lo o no? No hi ha una resposta concreta a aquests dubtes comuns, ja que dependr\u00e0 dels estatuts de cada comunitat i les successives sent\u00e8ncies que s&#8217;han produ\u00eft al nostre pa\u00eds per a respondre a aquesta q\u00fcesti\u00f3 s\u00f3n contradict\u00f2ries.<\/p>\n<p>No obstant aix\u00f2, des de fa pocs anys el Tribunal Suprem ha decidit establir jurisprud\u00e8ncia i estimar que l&#8217;ascensor \u201c\u00e9s un element essencial utilitzaci\u00f3 de l&#8217;edifici, que redunda en benefici, sense excepci\u00f3 de tots els propietaris\u00bb. Pel que, sempre que els estatuts no diguen el contrari, els locals dels baixos, si s\u00f3n propietaris, hauran de pagar tamb\u00e9 una part de la instal\u00b7laci\u00f3 d&#8217;un ascensor.<\/p>\n<\/div><\/section><\/div>\n<section  class='av_textblock_section av-jpl2107b-2087369db9e453c50cf7d5f41b2c34e0 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock'  itemprop=\"text\" ><p style=\"text-align: justify;\">\u00a0En qualsevol cas, el Tribunal Suprem va dictar una recent sent\u00e8ncia (la 232\/2014) que marca els seg\u00fcents punts a tindre en compte per a resoldre aquest tipus de q\u00fcestions:<\/p>\n<\/div><\/section>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-av_heading-08228d54b7333ec32286759de81e2101\">\n#top .av-special-heading.av-av_heading-08228d54b7333ec32286759de81e2101{\npadding-bottom:10px;\n}\nbody .av-special-heading.av-av_heading-08228d54b7333ec32286759de81e2101 .av-special-heading-tag .heading-char{\nfont-size:25px;\n}\n.av-special-heading.av-av_heading-08228d54b7333ec32286759de81e2101 .av-subheading{\nfont-size:15px;\n}\n<\/style>\n<div  class='av-special-heading av-av_heading-08228d54b7333ec32286759de81e2101 av-special-heading-h3  avia-builder-el-6  el_after_av_textblock  el_before_av_textblock '><h3 class='av-special-heading-tag '  itemprop=\"headline\"  ><span class=\"ez-toc-section\" id=\"Instal%C2%B7lacio_quan_no_hi_ha_ascensor_previ\"><\/span>Instal\u00b7laci\u00f3 quan no hi ha ascensor previ<span class=\"ez-toc-section-end\"><\/span><\/h3><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div>\n<section  class='av_textblock_section av-jpl25cjr-8672bddbc81797e014fc42170368e36b '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock'  itemprop=\"text\" ><p>Si s&#8217;instal\u00b7la un ascensor en una comunitat en la qual no hi havia ascensor. En aquest cas els locals comercials s\u00ed que han de contribuir, com la resta dels membres de la comunitat, a la instal\u00b7laci\u00f3 de l&#8217;ascensor, necessari per a l&#8217;habitabilitat de l&#8217;immoble. No obstant aix\u00f2, aquests baixos comercials quedaran exempts de les despeses derivades del manteniment de l&#8217;ascensor.
